Anaesthetic awareness which is intraoperative awareness, occurs where a patient becomes partially conscious or aware during surgery while under general anaesthesia. Despite advances in anaesthesia techniques and monitoring, anaesthetic awareness can occur, leading to varying degrees of consciousness and memory of surgical procedures.
It can occur for a number of reasons, such as;
Drugs Combination or a reaction
Patients may metabolize anaesthetic drugs differently, leading to unexpected levels of consciousness.
Dosage Incorrect
The administration of the anaesthetic drugs or inappropriate dosage can result in inadequate anaesthesia which leads to awareness and inadequate patient care.
Equipment
The monitoring devices or anaesthesia equipment did not operate properly.
Individual Patient Facts
The specific patient had an underlying medical condition, genetic considerations or a negative reaction to the drug administered.
Inititial Consultation & Legal Process
If you feel you have had inadequate patient care, it is important to start with endeavouring to factually explore the matter to ascertain if the cause can be identified.
Of the persons who feel inadequate care was undertaken, they will likely not get answers vis a vis communication from their care provider.
If the person wishes to investigate the matter with their solicitor, then all of the facts in chronlogical order and the medical records will need to be reviewed for the matter.
An expert medical witness will need to assess the matter in order to establish if there is a breach of duty in the case. A breach of duty must show a health care providers action(s) or omission(s) fell below the standard expected of a reasonably competent practitioner in the area.
It must be proven there is a direct link between the breach of duty of the injury or harm sustained by the patient.
