Gastric Band Medical Negligence Claim

The medical term for the band is called laparoscopic adjustable gastric band.

It is a device placed around a section of the stomach by a surgeon for weight loss purposes.

It is made of silicone.

The procedure is undertaken with a camera ie the laparoscope and then small incisions are made in order or the band to be placed towards the upper part area of the stomach.

A digital laparoscope can be placed at the end of the laparoscope or a telescopic rod lens system with a video camera can be availed of.

The camera with the adjacent monitor can show the inside of the persons abdomen for this procedure.

Laparoscopic surgery treatment options are less invasive than open surgery procedures and can also be used for hernia repair, appendectomy etc.

Doctors owe patients and duty of care and the care should not be substandard.

The patient should be notified of risks prior to the surgery to enable them make an informed decision about the procedure. Post operatively it is important to asses there is no infection, the band remains in place, and no other issue arises.

The person undertaking the procedure should exercise the exercise the skill, care, diligence that would be expected from a reasonably competent practitioner in the same field of medicine.
