Is a child born in Ireland to a non-national person entitled to citizenship ?
Evidently the law has to be applied to the facts of each case, but here is a general guide on the law for information purposes.
Section 4 – Irish Nationality & Citizenship Act
A non-national born in Ireland is not entitled to automatic citizenship.
A person can be entitled if a number of conditions are met.
The parent of the person must have lived in Ireland for 4 of the preceding years.
Was the person born before 2004 ?
Is either parent of the child an Irish citizen ?
Is either parent of the child a British citizen ?
Was either parent of the child entitled to live in Ireland without any restriction before the application is made ?
Is the non-national person born in Ireland not entitled to citizenship in any other country ? If not on this point alone, there is an entitlement to citizenship.
Citizenship by Descent
If a person’s parent is an Irish citizen or was an Irish citizen when alive then the person is an Irish citizen at birth.
Citizenship of Adopted Children
An intercountry adoption effected outside of Ireland can be recognised ie with an adoption order and the adopted child of an Irish citizen will be an Irish citizen.
