Garda Compensation Bill 2012

gardaThe minister has stated “The proposals represent a major improvement on the current compensation scheme for both Gardaí and the State. The majority of Gardaí who need to access the scheme will receive more prompt payments and the State will have reduced costs in administering the revised scheme“,

Most cases will be settled by the State Claims Agency by the making of an award of compensation without recourse to the courts. The proposed Garda Compensation Scheme will operate on a similar basis to the Personal Injuries Board.

There will be a right of appeal to the courts by an applicant who is dissatisfied with the award.

It is proposed all minor injuries and applications by Student Gardai and members of the Garda Reserve should be included within the scope.

Eligibility

  1. Members of An Garda Siochana who sustained personal injurie (not causing death) maliciously inflicted upon them in performance of their duties.
  2. Dependants of the deceased members who were fatally injured while on duty or while acting in the general capacity as a member of merely because of their becoming a member of An Garda Siochana.
