Case Summary
Our client, Tom was assaulted and battered in a nightclub incident. As a result he sustained personal injuries, loss and damage.
The individual who assaulted our client was subsequently prosecuted for the assault under the criminal law provisions of the Non-Fatal Offences Against the Person Act 1997 and convicted for the assault.
We commenced a civil law case against the perpetrator and the nightclub establishment for negligence, breach of duty and breach of statutory duty. There were failures of the duties in the Occupiers Liability Act 1995 by the proprietor and regarding orderly and proper management of the licensed premises.
Our client sustained injuries to the facial area, was left with a scar and a fractured elbow from falling to the floor.
He was out of work for four months following the incident, sustained economic losses in addition to the pain and suffering.
The case was commenced in the High Court and a full defence was put in by the nightclub establishment and liability was admitted by the patron who conducted the assault.
Medical experts were needed and a security expert was needed and the case was scheduled for hearing.
The case ultimately was concluded through negotiation prior to the hearing date for €83,000 plus costs to our client.
This incident really shook up our client, who was glad he could put the incident behind him.
