Guide to the Conveyancing Process

Conveyancing concerns the transfer of legal title from one house property owner to another.

The first step in any property purchase is financial for the buyer. The person will have ensured that they have sufficient funds, whether from savings, loan, or gifts to complete any purchase with all its varied costs and expenses. 

A good broker can assist you in arranging a mortgage. Gifts from parents can be tax-free up to a certain threshold, and many deposits come from this source.

A solicitor can help a person apply for the new help to buy scheme.

If the person is keen on a particular property, engaging with a surveyor or architect can be very worthwhile to conduct checks. 

A surveyor can also advise on any inappropriate extensions or works that may lack planning permission. The old advice caveat emptor ie buyer beware very much applies.  

When the contract documents arrive, you or your surveyor should inspect any of the maps to see if the map correctly marks the boundaries of the property.  

Contracts may be signed subject to loan approval.

A conveyancing solicitor will assist the person with the legal process, from checking the title documents and planning history so that the sellers’ title is in order, as it may not be so.  The service charges and taxes on the property may need assessment ie are they paid in full. The transfer document for the purchaser will need to be drafted. If parties are married or in a couple, a person should obtain legal advice on joint ownership versus & tenants in common. Contents inclusion in the sale contract may also need assessment.
