Join Family Application – UK National

UK nationals have many rights in Ireland, such as, the right to work without a permit, can enter Ireland without a visa, have access to public healthcare system which are quite unique due to the long standing history between the countries.

With the UK’s withdrawal from the EU, UK and Irish citizens rights to travel, live and work within the common travel area have been recognised in legislation in order that the UKs withdrawal from the EU would not affect these rights.

Family Members of UK Nationals

UK citizens have no automatic right with respect to having non-EEA family members live with them in Ireland.

The Department of Justice has introduced a scheme in relation to Non-EEA Family Members of UK citizens who wish to reside in Ireland.

EU free movement rights no longer apply to UK citizens.

Sponsor

The UK national, for example, Spouse of the non-EEA family member can be an eligible sponsor.

The sponsor is responsible for the family member they would like to come to Ireland.

The finances of the sponsor will be assessed. Minimum income levels are set out in the Policy document which is dependent on family size. The sponsors conduct while in Ireland will also be assessed.

The genuineness of the family relationship must also be proved.

Private Health Insurance & Policy Clearance

An applicant must have this and have a police clearance cert also.

Preclearance & Long Stay D Visa application

Applicants must firstly apply for a visa or apply for preclearance letter before they come to Ireland, which is dependent on the persons nationality.

A preclearance letter of approval, if granted, must be provided to the immigration officer upon entry into the state.

If the application is approved for a visa required national a Long Stay D Visa ( Join Family UK National ) will be indicated on the persons passport.

For non visa required persons whose application is granted, a preclearance letter of approval will be furnished.

Registration & Irish Resident Permit Card

Non-EEA nationals living in Ireland for longer than 90 days must register with Immigration Service Delivery.

If an Irish Residence Card is granted, this will generally be for a 12 month period subject then to any renewal permission sought.
